Hi there, I have completed my MSc from Uni under tier 4 visa in February 17,2014(date on my certificate). I had one extension last January 2014, and got visa until 30 September,2014. My Supervisor was about to leave, therefore I had to submit my project earlier and finished early (received result on 28 February).
Now I want to do an MBA(another level 7) from HEI, and an University accepted my application. The course start date is 28 July, 2014. Uni told me that, I can only apply for the Visa before three months of course start, and they will issue me the CAS on 28 April, 2014.
Meanwhile, I have received an email from my previous Uni that they have reported the early completion of my study on 9th April, 2014. Although, I have not received any letter, sms or email from HO regarding my curtailment yet.
I spoke with a lawyer regarding this and possible impact on my new course, he advised me, if I do not receive any means of communication before 2nd of May 2014, I will be able to make an in country tier 4 application ((within 88 days(60 days to new visa expiry date from letter date plus 28 days to start a new course)).
I am sending my application on 29th this month(29/04/2014).
My question is, how likely to be successful considering this timing issue? I have read all the curtailment guidance on PBS system, and I need to be communicated by HO for the purpose of curtailment to be effected, is it true?
An appropriate advice will be appreciated. Thank you.
