Date of Student visa application

Post by CHG » Wed Jan 12, 2022 2:54 pm

My wife's Tier 4 visa and my son's PBS dependant visa expire on 30 Jan 2022. I have already applied for ILR (LR) on 1 Sep 2021 (standard application) and decision is now pending for over 4 months 11 days.

If I don't get a decision on my ILR application before 30 Jan, I intend to extend wife's Student visa and PBS dependant visa for my son on Jan 30th. The reasons given on my wife's CAS letter enables her to extend her student visa in UK.

If my ILR is approved before their applications are decided, then I plan to vary their applications to Spouse visa and British citizenships respectively. Due to this reason, I want to apply no earlier than 30th Jan to allow a better chance of my ILR application to be decided before theirs.

My question is, if their visa is expiring on 30 Jan 2022 and if they make an in-time application but the biometric appointment or uploading of documents using the app (last time we were asked to use the app) takes place after 30th Jan, will it be considered an in-time application?

The last time we extended her Tier 4 visa, the email to upload documents via the app came a week after we applied

"Date of application" is defined in paragraph 6.2 of the immigration rules.
