+90 days absence , does it matter in my case ?

Post by MPI » Fri Mar 04, 2011 2:12 pm

2 years ago I came with some contractual complication with my employer and I won the case. However they were not allowed to keep me in office , but suspended me with full pay for the full length of my contract.
For that period I left UK and stayed away for around 100 days while I was fully paid here in UK.

My question is , what evidence is required for 5 year continuous stay?

I can still prove I was in UK for that period through my bank statements , payslips , bills etc.

Any advice appreciated.

My question is , would this matter when applying for ILR ? considering the fact that I was still employed here in UK.

Also , I m keen to know how HO checks if I was away. My passport was never time-stamped with the day I left?

Don't say that you can prove that you were in the UK for that period, but that you can lie and claim to be in the UK during the period, thanks to documentary evidence(s) such as bank statements / payslips / bille / etc. that may help you make a lie appear a truth.

Do you have arrival stamp of the destination airport in the passport? Did you fill up a landing card when you landed at a UK port upon return?

sure ..

yes my destination must have stamped my arrival . they normally do at back of passport .

On return to UK , yes I filled a landing card , but don't think I mentioned anything regarding my duration of stay away.

Date of landing - date of arrival stamp at destination airport (UK) = days of absence from UK! I am sure the caseworker can figure this out, just as everyone else can.

Anyhow, coming back to the point, as per IDI, 90+ days sigle absence are not allowed. Work related assignments may be ignored when supported by employer letters, but it is unlikely that a caseworker will apply discretion, if allowed to do so, in your favour given the fact that your absence was personal / voluntary.
