Definite start date for employee under Tier 2 application

Post by braveheart2009 » Thu Jun 25, 2009 1:56 pm

My application was for Tier 2 and I had 60 points(requirement is 50 points) which the Visa officer approved but because of maintenance funds mistake on my part it was refused.

My employer is re-applying for Certificate of Sponsorship and has A-Grade Licence. Now because my application for entry clearance was refused only on the grounds of maitenance funds(My wife bank statements and her undertaking that she is responsible but because we printed off the internet and we did overlook that the bank statements must be stamped/signed by the bank) .I am on H4 visa in US and not allowed to work.

We are submitting the same contract and same start date but with an additional letter from the employer that the start date would be as and when the Consulate approves my application and his undertaking that the maintenance would be taken care of by him should there be any necessity.

Will it be ok

Regards,

So has the work start date actually passed now? If they've issued a new CoS the start date should be a reasonable date for you to get your visa (say 2 weeks away, for example). The start date is not really a problem though - the consulate should know that the start date is flexible and dependant on the visa issuance.
