Delayed ILR Application

Post by jamieG » Thu Aug 29, 2024 4:43 pm

Good evening,

I hope you can assist me.

My ILR application has now been delayed for 1 year and 1 month now. I’ve chased the UKVI numerous times and even written to my MP, but nothing has changed.

I’m really confused about what to do next. Could someone please advise? I’m not sure if a Pre-Action Protocol (PAP) will make any difference at this point.

Any guidance would be greatly appreciated.

We certainly can't tell you why or how your application is taking that long. This long delay might be due to some ongoing investigation related to your application. You could instruct your lawyer to file a PAP

Could I file a PAP myself, given that I didn’t use a lawyer for the initial application?

PAP has nothing to do with the immigration system, this is a process under the administrative law. You are highly advised to engage a legal professional as this process requires following proper civil procedures, dealing with the tribunals and generally navigating the administrative law. You may find legal charities that provide free legal advice or representation

UKVI has a template for PAP: https://www.gov.uk/government/publicati ... ial-review
