departing US early for existing H1B and then transgfer later

Post by quoteorderdude » Fri Dec 07, 2007 11:55 pm

I was working until May under an H1B visa when the company i worked for split up in form two seperate companies. At this I decided to leave the company. My visa was to last till Jan 2009 and before I knew my termination papers were signed and I was told that the visa was void and would need to return to my home country as soon as possible (UK).

Now 6 months later, a very similar firm are really keen to hire me. Can I reuse my old H1B visa and transfer it, or has it became completely void? Or am I back to square one and is it going to potentially harder for me to get another H1B?

Many thanks in advance,
James

.

You need a new visa. The term "Void" is quite specific.

You might have been able to transfer the H-1b between companies at the time, but the six months' passage of time has eliminated all possibilities. Even a few days would have done it once the visa was voided and you left the country.
