Next year my Brazilian partner is going to apply for a UPV here in the UK, she is currently here on a SV.

She has a 15 year old daughter in Brazil who will be 16 when my partner will be able be apply for UPV status.

The daughter currently lives with her grandmother, the father has not seen the child for about 10 years and has had nothing to do with the child's upbringing apart from paying some minimal maintenance.

The UK visas and IND webistes seem to suggest that the child is only eligible for UK settlement if my partner applies for settlement from Brazil at the same as her daughter. Or her daughter can apply when my partner has ILTR but that would be when her daughter would have just turned 18, ie, no longer possible.

The IAS website has somthing on it which suggests that her daughter could apply either now whilst my partner has a SV or when she has her UPV and would be given a visa for the same timescales as the temporary visa of my partner.

OK, if this is possible, how do you do this, what form does her daughtrer appy on ?

And if it is possible, what happens when her daughter turns 18 before my partner has her ILTR ?

Does the daughter get ILTR when my partner does even though the daughter is now 18 or does she have to return to Brazil ?

Anyone have knowledge or experience with this type of scenario ?
