Hello all,

Hope this case might have discussed earlier in the forum. But i didn't get specific answer to this question. Please could u answer me this.

I am eligible for ILR in November 2011. I am a workpermit holder. My wife and kid stayed here only 3 three years from end 2006-early 2009. They are away from last 2 years. As per the rules i believe they have to stary in UK for minimum 2 years and cohabitation for min. 2 years. This i could not show as they are not here right now in UK.

My question is
1. Will they be able for ILR along with me? Please clarify, i doubt..
2. If not will their dependent visa is valid?

Your responses shall be much appreciated.

If you are a WP holder (not a Tier 2 migrant), then your dependants (spouse and/or child(ren)) are not subject to any residential requirements and may apply for settlement at the same time as you (196D and 198).

Thanks for your reply. My worry is Cohabitation proofs. I have some like bank statements joints of 2011 and GP letters etc. But i don't have anything in 2010. Do you think this affects? or any suggestion please.
