Dependant Partner Visa Application - Skilled Worker

Post by gnm » Thu Feb 02, 2023 11:18 pm

Hi all,

This forum has hugely helped me every time answering lot of queries.

I got my ILR in 2019 after completing my 5 years on Tier 2 General. My wife applied for PBS Dependant in 2018 for a validity of a year and a half as my tier 2 visa was expiring in Dec 2019. She then applied for PBS dependant (after I got my ILR) through Tier 2 category and she got it for another 3 years until Jan 2023. She is not yet eligible for ILR as she hasn't completed her complete 5 years in the UK. Hence she had to apply for another extension. I still hold my ILR and haven't applied for my citizenship yet. As PBS dependant been stopped or replaced with Skilled Worker Dependant, she applied for Skilled Worker Dependant (extension) in Jan 2023, and application has been successful. However there are couple of issues to be addressed

Questions.

1. In her decision letter via email states that
"Your application as a dependant of <my name> on the Intra-Company Routes has been successful".
But she applied for the skilled worker dependant visa. I have checked the application form and indeed "Skilled Worker" was chosen.
In the BRP, its mentioned "Dependant Partner Leave to Remain". So I am confused on the email statement regards to the decision mentions on Intra-Company Route.

I am more worried on this query - as I believe Intra-company route is a different category and if it might affect her ILR application as she should be eligible late this year

2. She applied for 3 years and paid the IHS charge for 3 years, however validity of her visa has been granted only until 21st March 2024. I am on ILR, so I am not sure on what basis the validity was chosen.

Can someone please advise about my queries?

Thanks in advance.

Hi,

Can somebody please assist if this is an issue and needs to be raised with UKVI? If so, does my wife need to apply for an admin review?

Thanks.

Hi CR001, Zimba,

Can anyone please advise? Looking at the admin review , looks like it must be applied only if the visa is refused. I guess I shouldn't delay it longer and I need to report this asap. But I am stuck, I am not sure whom to contact to get this reported and corrected.

Thanks.
