Dependant's ILR eligibility

Post by RamyAbdallah » Fri Aug 15, 2025 9:14 pm

Dear All,
I arrived in the UK in 2016 to begin my PhD studies. After completing my PhD, I worked as a Research Fellow for one year before leaving the UK on 3 December 2021. My visa expired on 14 December 2021. I returned to the UK on 5 April 2022 to take up another position, using a new entry clearance vignette.

My dependants were in the same situation, having arrived in November 2016, leaving in December 2021, and returning in April 2022 with new entry clearance vignettes. They are expected to complete 10 years in the UK in November 2026. Would the four-month absence during 2021–2022, when they were without a valid visa, affect their continuous residence or eligibility for ILR? Or would these four months, even without a valid visa, not affect the 10-year continuous residence requirement, unlike the five-year route?
Would they be able to apply without any concerns by November 2026?
