I am in a unexpected and confusing situation as a Tier 1 General Dependant.
My wife was the main applicant, but since we had a 1 year old baby when we got our visas, I decided to travel first and find job and accomodation before they can move to a new place. I explained this situation to the Immigration Officer and was weaved through without any issues.
When my wife applied for my child's Tier 1 Dependant visa, she was told by the embassy worker on behalf of the counsil that it might be the case that I am in breach with the Immigration Law to be working in UK without the main applicant present. They advised me to call the Head Office in UK and ask them to make sure. I did so, and was assured I am not breaking any law since I have a work permit type visa, which allows me to work independent of my wife having entered the UK or not.
So, we just applied and got refused by other reason (we were under the impression that once we provided the maintenance of funds for our visas, we did not need to do so when applying for our child's visa, but it appeared that since the main applicant never traveled, we had to provide evidence for us all again). After that, we decided to apply for our child as a General Visitor so she could accompany my wife and come to UK before we apply for her again in 3 months for Tier 1. This was refused as well, giving the reason that we are trying to go round the law to apply for visitor visa, when her Tier 1 was refused. This was not the case, we just wanted to be with her before we apply for Tier 1 for her again.
In the refusal letter, it was mentioned that despite being advised that I don't have the right to work in UK without the main applicant, we did not try to fix the situation. So, considering this a legal proof of that, my wife left behind our 1 year old daughter with a babysitter and joined me immidiately.
Now, I wanted to apply for my mother to come visit us over Christmas, and she was refused as well. One of the points in her refusal letter was also that I don't have the right to act as a sponsor since I disregarded the rules. Now, I am told that because of all this, I can't travel to my home country for New Year, since I might not be able to come back to UK and might be banned entry to UK for 10 years.
Please advise. This is rediculous, I have never in any way intended to break any law had I known that I am doing so. Nowhere in the requirements and information about Dependants does it say such a thing. This is a pure misunderstanding which came from desinformation, which I don't know how to correct now. Any advise on this matter will be highly appreciated. Thank you!
