Dependant Visa in-country application

Post by beecharmer1800bc » Tue Feb 15, 2011 9:54 am

Hello good people of this forum. I need some help here please.

I am currently on a Tier 1 General visa valid till May 2013.
Last year, I got married to my wife who is on a Tier 4 (student) visa and we have since had a son who is 3months old.
I would like to enquire if it is possible for both dependants to apply for their dependants’ visa in-country?
An immigration lawyer seems to think this is possible, but I don't want to lose money based on wrong advice so I'm asking for members to share any info that will enable me make an informed decision.

I will be most grateful if anyone of you can provide an up-to-date information about my family's eligibility to apply in the UK without leaving the country.

Your spouse - no, as 319C(h) is not satisfied.

Your child - Was he born in the UK and has no visa on his passport? If yes, then an in-country application for leave to remain can be made. See also Child born in the UK.
