I am already 8 years in the UK and never gone out the country ever since I came here. Wife got her ILR on her 5th year and because mine was only 4th year in the UK that time, the Home Office granted her ILR but mine, only Residents Visa with expiration til 2013 and unluckily, when I was still waiting to complete 1 more year to apply my ILR, our relationship broke down after 14 years of marriage with 2 kids.

She was my sponsor when i entered the UK. We havent gone to legal divorce. My ex got her citizenship already and also the kids. Mine still have an expiration and never applied for ILR. Can i apply for ILR on my own?

Caused of separation: False DV case (full of lies and drama but no evidence) that has been dismissed. I pleaded not guilty in Court. I turned out to be the victim in the case.

If your wife was under a work-based category I wonder why you think you, her dependant, needed to complete five years of residence.
