Dependent eligible for ILR after visa expire and UK renter

Post by Viswanath » Mon Oct 07, 2013 8:05 pm

Hi All,

Can anybody help me in this situation

1. I entered in UK in the year of 2008 as HSMP holder along with my family wife and son.
2. I was here till 2010 May . And I have extend my visa and convert into Tier 1 general. After extension I left the country
3. Again I entered into UK in April 2012 alone and still my family in India. After that I extend my visa and it's approved till 2015
4. My daughter born in India.
5. And wife's and son's visa expired.
6. Anyway I am going to apply for extension for all.

My query,

1. As per the new rules (June 2012), Do they wait for 5 years or will they eligible for ILR in 2016 along with me?
Note: my wife and son enter into UK before
2. What about my daughter eligibility? Does she wait for another 5 years?

Thanks,
Viswanath
