Dependent ILR

Post by yassin88 » Tue Jan 28, 2025 10:28 am

Hi,
Thank you for your help.
I was granted ILR for 5 years on tier 2 visa on 23/01/24. I am currently in the process of applying for UK citizenship.
My question is regarding my wife and 2 children both under 10
They originally came to the UK on 31/12/2020, they returned to our home country on 18/03/2021 and stayed there for over 6 months, came back to the UK on 25/12/2021, and they have been here since then apart from small trips here and there.
They are on dependent visa which is valid until 01/27.
When can I apply for ILR for them, and would it be on the dependent bases or if I become a British Citizen it will different?
I appreciate all you help

They will stay under the current visa until they are eligible for ILR. You becoming a citizen does not change anything. If your spouse stayed outside the UK for more than 180 days, then their continuous residence is broken so they have to reside longer to be eligible for ILR
