Dependent Kids Age 19+ on Tier 1 (Entrepreneur) Extension.

Dear Members,

Today I got a Shocking news :shock: that my 2 Sons will not get Extension after 3 years and then No Indefinite Visa for them after 5 years because they both will be over 18 Years in May 2016 but my wife will get it as this is UK General Law Applicable but the person was not aware about the Law Applicable on Family came UK under Tier 1 (Entrepreneur) category visas.

I am on Tier 1 (Entrepreneur) Visa with 3 Dependent Visa (Visa Stamped in April 2013) under my sponsorship as below :
1). My self as main Applicant.
1). Wife - Spouse - Mother of my below mention 2 Kids.
2). Son - Will be 20+ at the Time of Extension Application in May 2016.
3). Son - Will be 19+ at the Time of Extension Application in May 2016.

My younger son is in College and studying as home student because he was under 18 years when he join college but my elder Son goes in University and doing Engineering (Undergraduate) as a Foreign Student (Higher Fees Payable then Home Student). Any how both Sons are Full Time Students and they never done any job/work for even 1 Hour nor they will do even we apply our Extension.

I have to Apply for Extension in May 2016, I request Some One can tell me the Rule of Extension after 3 years and then Indefinite visa after 5 years as my wife and Sons were my Dependents when I got Tier 1 (Entrepreneur) category visa in April 2013 because I think that we all should get the Extension after 3 years and then Indefinite visa after 5 years as we all get our Tier 1 (Entrepreneur) visa together.

May I know What is the Rule Applicable on me and my Family as we all are on Tier 1 (Entrepreneur) Visa.

Please write in Detail who knows the Rule as well who had Similar type of situation and when he apply what had happened with them (Case Study) as this will Help Many Readers who follow this Forum.

Dear Readers,

I assume might be I am unable to Explain the issue properly because No One Reply until now.

Therefore I explain again.

An Applicant was Granted Tier 1 (Entrepreneur) in April 2013 with 3 Dependent in which Two Sons are under 18 that time.

Extension has to be Apply after 3 Years of Visa mean in April 2016 and in these 3 years both the Dependent Sons cross the age of 18 years and as per UK Law they will be Treated Major instead of Minor which they were when Tier 1 (Entrepreneur) was Granted in April 2013.

Other side both Kids are Full Time Student and they are Not Working at all.

Kindly let me know, What is the Law Applicable on Tier 1 (Entrepreneur) Extension as this is a Time Consuming Visa and its common that the Kids who were under 18 at the time of getting First Visa will Grow-up and been over 18 when the Extension or ILR comes.

Unfortunately you are correct, they will NOT be treated as minor once 18 and above according to UK law. They will have to apply based on their own merit. That is the rule, even if you have a british passport and kids are 18 and above same rule applies. Your kids will need to switch to another route, is awkward but that is the rule. I know a British mother who brought her kids to the UK long time ago and forgot to apply for their british passport which I think is really silly of her, now her kids are more than 18years old and they applied ,HO refused them for the third time now, the mum is shocked, she is british but kids are potentially illegal.she is running about going to tribunal etc but no way, her kids need to apply based on their own merit or may be removed from the UK

I also know one of the family. Mum is british citizen and sons are now illegal even universities are not accepting them. One of her son is extremely intelligent and I was shocked to learn that he continue his studies. :(
