WP Dependent to Tier 1, Clarification

Post by Mohammed » Wed Apr 30, 2008 9:23 pm

Hello to All,
I am planning to apply for Tier 1 general. I have few queries, hope you will clear them
My situation:
At present I am living and working in UK from past 1 year
My visa is: work permit dependent (am on my wife's visa, who is a work permit holder). Am an Indian National.

So am planning to apply for a Tier 1 general visa however my wife will remain a work permit holder. I have checked my eligibility through the tool and am able clear the minimum (90).

My queries are
Can I switch in country (with in UK) or should I go back (my understanding is apply from India?)
Maintenance Fund: How much should I show, should it be 800 or 2800, this is where my real confusion is....Since am not allowed to apply 'incountry' should I show 2800 and should it be for the last 3 months even if I apply before 29th June 08?

Any help would be appreciated
Mohammed.

You cannot switch from dependent visa to Tier 1 visa from within UK. You will have to apply for EC from India.

You will have to show the minimum funds for one (principal) applicant. Not sure if that's 800 or 2800 if applying from India. I think the 3 month criteria is waived of until 29-Jun irrespective of the location you apply from.

Hello hsmpinuk70,

I had a similar query regarding my wife's dependent work permit. I am currently holding an employer sponsored work permit which is stamped and valid till November 2009. By virtue of this work permit, my wife has a dependent visa stamped and valid till Nov'09. We both are currently waiting in India for my onsite deployment to UK; which may take a while. In the meantime, is it possible to switch my wife's dependent visa to a Tier-1 work permit? Will it still go through similar checks as for a general Tier-1 application?

To give you a backdrop, my wife has a gap of a month in employment (December 2007) due to our marriage and her job switch. Since general application does not entertain a gap (excl. Maternity leave) I wanted to know how I can take her Tier-1 work permit forward using her dependent visa.

Your response will be much valuable and appreciated. Thanks!! :)

Regards,
makyog
