Dependent to Tier 1 - Effect on ILR

Post by pkumar » Mon Aug 03, 2009 12:35 pm

Experts,

If someone is on dependent visa for say 2 years and then switches to Tier 1 main applicant and stays on that visa for 3 years. my question is does this qualify this person for ILR since he/she completed 5 years in total? I would apreciate if someone can throw some light on this. Also if there is any issues / problem / restrictions.

Thanking you

PK

The answer is NO.

When a dependent switches to t1, its basically change of visa status. You cannot "switch" from dependent to T1 in country. You will have to apply from your home country for the same.

If you do so, your 2 years (on dependent) will be gone and counter will reset from the day you enter the country on new T1.

Thanks Nksg.
Do you have any link which explains what you just said.

Push / Chetan or anyone ... do you have anything to add?

Check this link. To apply for ILR you should complete 5 years in any of the mentioned categories.
