dependent visa extension when one partner has ILR

Post by roadjacker80500 » Mon May 26, 2025 2:56 am

Hi
I got ILR June 2024 (on 5yrs route) thanks to admin here. Now my wife needs to extend her dependent visa. She needs another 3 years on dependent visa before being eligible for ILR on a 5yr route. Her current dependent visa expires in Aug 2025.
Q1- How early can she apply for 3 year visa extension prior to her current visa expiring in Aug 2025.
Q2- I used to be on Skilled Worker visa prior to getting ILR and used to use my COS for her visa applications as well. Now I have the ILR and don't need/have any COS, however, I am still in the same employment. What documents specially in terms of sponsor does she need to apply for a 3-year extension? She is not working.
Q3- I will be eligible to apply for Naturalization in few days. Does it make a difference to her visa extension application if I get UK passport before she renews the visa?

Thanks for your expert advice

1. Anytime before visa expiry.
2. Those have no relevance to her visa. She is your dependant and your previous sponsorship and employment are irrelevant.
3. No. That also has no effect on her visa application

Thanks a lot for the above.

If we apply too soon, would it affect applying for ILR status 3 years later as the visa renewal is only for 36 months? To be specific, my dependent partner's visa expires on 15 Aug, 2025. She first came to the UK on 28 June 2023 and 5 years will complete on 28 June 2028. If we apply for urgent extension visa today and get the results in few days, would the 3 years extension visa not expire few weeks before 5 years are completed? What's the advice here. Should we proceed with application or wait for a few weeks? Asking this as we are planning urgent travel in mid July and don't want to be in a situation where the application is in process and we can't leave the country.

also, if you can provide link for correct application page for dependant visa extension when one patner has ILR on gov uk, I'd be grateful. I have tried to fill in several application forms but they seem to be of wrong category and they don't let me proceed further unless I provide them details of my skilled worker visa and my work start date which is a bit weird

You are thinking far in the future. What happens in 5 years is unknown. Major changes to the immigration rules (particularly around the rules for settlement) are expected to be introduced by the end of the year, so I suggest not to plan for then from now.

As the rules stand now, being short of a few weeks is not an issue.
