Dependent visa issued after 9 July 2012

Hi

My Visa status is PBS Tier 1(General) my visa isexpiring on 9th Feb 2015.


Following are the details

Main Applicant Details
Visa duration : 01-Feb-2010 to 01-Feb-2013 (3 years)
Visa Extn duration : 09-Feb-2013 to 09-Feb-2015 (2 years)
Entry to UK: 27-March-2010

PBS Dependent Details
PBS Dependent Visa duration : 09-Feb-2013 to 09-Feb-2015 (2 years)


1) I just want to to know whether i should apply for ILR or go for extension as i came to UK after 54 days of visa issue date ?

2) My wife was issued a PBS dependent visa on 09-Feb-2013 (she cannot apply for settlement with me as she was issued a dependent visa after 9 July 2012)

I am thinking of booking PEO appointment for myself on 12 January, 2015 , 28 days before the expiry of my visa i.e 09-Feb-2015. But I am confused about how to proceed with my wife's visa application?

I think there are two options:

Option 1) Extend her stay as PBS dependent
Option 2) Apply for FLR(M) after getting my ILR

- Can somebody confirm me if I go for settlement through PEO 28 days prior expiry of my visa then can I apply FLR (M) for my wife and would it reset five year qualifying period?

- Secondly if i go for option 1 then can me and my wife book PEO appointment for same day?

- Suggest me if there is anything i am missing?

You can apply for ILR 28 days before to 1st Feb 2015

Yes Correct she is not eligible to apply for ILR

as your 1st entry visa grant date is 1st Feb 2010 So you can apply 28 days before to 1st Feb 2015
with regard to your wife she will apply for further leave as PBS Dependent

Yes this is better
Option 2) Apply for FLR(M) after getting my ILR
No if you apply FLR(M) then your wife continus stay clock reset and she should have to spend further 5 years in order to qualify for ILR

Yes you can book 2 different appointments Set(O) ILR for you and PBS Dependent for your wife at same date
