Dependent visa

Hi,

I am currently on Tier 1 visa and my visa is going to expire on 23rd Jan 2014. I am going to apply for ILR in december 2013.
My wife is intending to apply for dependent visa this month. Is she eligible to apply for dependent visa as my visa is going to expire in 4 months time?
will UKBA not refuse visa if she applies now?

Please advise
