Hi,

I am on Tier 1 general and due for ILR in Sep 2013. My wife is on my dependent visa from the past 1 year. My query is, if she goes back to india for maternity and returns after Sep 2013, can she apply for ILR after staying for 1 more year or will she have to start the 2 years cycle again.

Are there any exceptions for maternity in case if she has to complete the 2 years eligibility criteria?

There is no holiday limit for Tier 1 dependent. She will be eligible to apply for ILR with you. However, it is advisable not to stay away from the country for so long. As this could raise potential doubts of making UK your main home.
