Deported from other country could get HSMP Dependent EC?

Hi, Please do help me.

I was deported from Japan 4 years ago for overstaying. My husband got HSMP approval.

My questions are:

1. Could my deportation from Japan will affect my husband HSMP EC?
2. Could I get also HSMP EC as his dependent?
3. Is there a law in the UK that if you are deported from other other can't get EC?

Is there somebody here who is in the same position?

Please help me..

We submitted our documents for EC last july 2, 2007. since then we have not received any feedback from them; like interview etc...

Did you gallantly provide this information of deportation to them in your application?

Yes. I provide my deportation issue in my VAF1 Application form. I just wanted to be honest as I could to the UK Embassy.

Is it true that June-Aug is the busiest time for UK Embassy?

oK THEN you may have a problem, I didn't realize you provided the info, don't see why you provided it either. Did it ask you about deportation from other countries or just UK? Do you mind explaining the whole story instead of me pulling teeth to get a complete picture.

There was a question in the VAF1 form about deportation from other country. I checked yes and explained everything.

there was a stamped in my passport about deportation from japan.

So, I cant lied anymore since it was shown in my passport.

I just overstayed in Japan. No criminal offense or whatsoever. I even submitted my deportation order to the UK Embassy. As what I have said, I just wanted to be honest as I could. Also, the reason that I admitted that issue is when the time comes that when we apply for ILR I am not worried that if they found out my deportation from Japan would lead to my removal from the UK. I think there is background check before approval of ILR. I just wanted to go to the UK without hiding any past immigration matters.

Do you think it could lead to refusal of our EC?

Hi Edna, I'm also from Manila. Did you submit your papers by their courier service? You should follow up by calling the British Consulate, the phone number should be on their website. They also have a fax number. I was able to contact them 3 years ago when there was a mistake on my visa.

No. I did not contact the UK Embassy..My husband called the UKVacs and they told him that our documents still in the embassy..I am quite nervous since we dont receive any feedback from the embassy.

Do you think my past deportation order from japan as overstayer will affect our HSMP EC application?

You can contact the embassy and ask if your application has been passed to on to a visa application officer. It has only been a month, however, so don't expect them to have reached a decision by now. Just ask them if your application has been received.

As for your deportation - was your husband in Japan with you at the time, or were you living/working there on your own? Doesn't matter, really. It should not be a problem for your British application, as long as your husband has enough evidence to support you, that his visa is valid, etc. However, it might be that you're called for an interview. I don't know the service in Manila so I cannot tell you what to expect, but, normally, overstaying in one country doesn't affect your application for a UK visa. In fact, many people who overstayed in the UK still manage to secure a visa! So, don't panic too much.

As an aside....do you speak Japanese?

Hi Edna, I am not sure, I think they will want to interview you because of the deportation order. I don't think they will just reject your visa without talking to you first. If it were a tourist visa, maybe they would reject you, but I think they would look at the HSMP more closely. Do you and your husband have other visas in your passport (tourist, work, etc.) and no other problems with other travels? It would also help if he worked outside the Philippines before, but not required. Anyway, I think it was a good decision to just put the deportation details in your application.

My visa took 14 days to process, which was standard for the UK embassy back in 2004. They could be busier / slower these days. If you are really worried, just call them. You can ask if it's already with an entry clearance officer and how much longer the wait would be. I found the visa personnel to be helpful, and if you are polite with them they won't mind that you called.

Actually I overstayed before in japan then I met my Filipino husband who was an engineer there. I surrendered to the Immigration went home in the Philippines and we got married. I applied for dependent visa and got approved.i used my married name.. i did not informed the japanese embassy that i lived in japan before. i went back to japan again..last 2003, a company offered me a job and they applied for my work permit. i submitted my college diploma and transcript which is my maiden name to the immigration... and thats it...they found out that i overstayed before...so they asked me to leave. and told me to apply again after a year as penalty. since it was stamped in my passport, i declared it to the EC application in the UK emabssy. what do you think....you know, im so worried...got depressed lately..My husband and I have US tourist visa valid until 2012. My husband came home last 2004, his company in japan opened a branch here. From 2004-2006, he travelled to Japan 2 times and no problem at all..I was only the one who has an immigration issue in Japan. Last 2006 also, I visited Singapore.

Why did you overstay?

Good luck! I think it's good that you and your husband worked and lived overseas before and that you have US visas. I think they will want to interview you before issuing your visa, so just be patient.

My Mother is married to Japanese National. After college, my brother and I went to Japan for a 3 month tourist visa. While in Japan, my stepfather wanted to adopt us. So he filed an adoption paper. But the adoption took so long. Our visa has expired because the immigration did not grant us extension of visa. The court told us that its ok because we are going to change our family name once the adoption released. The proceedings lasted for 6 months. And we were approved. But when my stepfather filed for change of status as his adopted children, the immigration denied us.

Since my maternal grandmother died already, we don't have anymore guardian here in the philippines. and we wanted to stay with my mother since we were separated from her for a long time.
