Difficult Hubsand

Hi,

My girlfriend has residency in the UK and has recently left her husaband and now he says he says he is going to try and get her VISA revoked and her deported by saying she lied to get her VISA.

My understanding is now whe is a resident there is nothing he can do. We have also confirmed this by speaking to a immigration lawyer.

Her husband has been harrassing us by making constant phone calls and sending emails.

So we went to the police and made a report about this. I spoke to the Police today and they say they have a 12 page report on this. What worries me is that even though we made the report together they purposefully came around when i was at work and delibrately did not put my name on the report until i requested this.

Is my girlfriend untouchable by this idiot or do i need to seek legal advice.

Any assistance with this is greatly appreciated.

When u say residency do you mean ILR? If so she's safe. If it's FLR (if two year spouse visa) she's not safe cos he has to co-sign for ILR...

What country is she from?

Hi Kev - we need more details. Where is she from? Where is her husband from, and what is his immigration status? How long has she been here and what visa is she on?

On what basis? Did she have a 2 year spouse visa first? Or some other route? Where is she from?

How long after she got ILR did they split?

She had a 2 year spouse visa, my girlfriend is from Thailand we just want to get on with our life now and put this behind us. I have the police coming on tuesday night and i must say i am appalled the way they conduct themselves.

I don't think there is a lot the police can really do. Surely this is a civil law matter? You need to get a legal injunction against this guy, then if he breaks it the police can get invloved.

You don't mention physical contact, just emails and phone calls - why not change your email address and phone number as a start?

There is a criminal offence of harrassment as well.

Is your girlfriend still on the 2year spouse visa, and if not, when did she get ILR and when did they split? In order to advise about the immigration aspects, that information is essential.

Well, if she already has ILR then that's the end of that, there's nothing the husband can say or do to get the visa revoked.

Your girlfriend is safe from being deported.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Your girlfriend has ILR, so is untouchable, and his threats mean nothing. He has no power over her immigration status, and I agree that this is harassment. I recommend that she sees a solicitor and gets an injunction.
