Am new to this so I actually didn't know where to post this query, so if its in the wrong area can someone kindly redirect my query....
I am a Non-EEA due to apply for permanent residence after having been married to an EEA national. We are in the process of a divorce and awaiting the Decree Absolute as six weeks have already elapsed.. ( I havent applied for it yet)
I have several concerns with regards to my application for permanent residence..
1. At what point am i supposed to inform HO that we are seperated.. as we are still awaiting Decree Absolute?
2.Should I write to HO and inform them of this now before my current stay expires and request for confirmation of Retention of Right of residence or should I send in an application for permanent Residence and what should I include...or simply what to do in view of this situation....
3. Should I go through a solicitor and will this have any weight on my application.
2. Which form should I use? I cant use the EEA4 as I am no longer an EEA familly member
3. My partner was exercising her treaty rights as a student for the first 3 years of our marriage (the marriage siezed to exist after 3yrs 6 months) and i have copies of her transcripts to prove this plus a P60 for one year. Basically I have proof of her exercising treaty rights covering the time we have been married but these are not originals as we are no longer speaking.. will these suffice?
5. Am i supposed to provide these evidence for treaty rights upto the time or date of the Decree Absolute or upto when the marriage broke down.
6. I also plan on including my own P60s covering 6 years that ive been in the UK
7. I am planning also to get married to another EEA national with Permanent Residence and whom we recently had a child with and currently living together.
Problem is that she's also waiting for her Decree Nisi to be made Absolute before we can get married and this will take us till july before we can even book an appointment at the Register which apparently they are way overbooked....leaving us with dates around August when my current 5 year residence expires...
Whats the best way to go about this whole scenario.. I know it seems kinda complicated but we dont choose some things..
