Discretionary Leave extension and Recourse to public funds

Post by Tklicious » Fri Feb 28, 2014 11:09 pm

-I came to the UK in April 2002 on a student visa.
-I applied for further leave to stay in June 2005 on my child's ill-health
-I had a child who will be 11years in March this year(born in the UK)
-I got my 3 years discretionary leave to remain in march 2011, based on my child's medical issues.-this child was born in UK
-I had my 2nd child in February 2011
-I was allowed recourse to public funds. I started working April 2012 and works full time .
-I had my 3rd child in September 2013
-I am claiming housing benefit, child tax credit, child benefit and gets council tax rebate as a single mother.
** My first child with the medical issues now has British passport based on 10 year rule.
**My 2nd child has British passport through his father.
**My 3rd child has no British passport.

1). I want to apply now for another 3 years, will all these benefits affect my application?
2). Please Will FLR(FP) form allow me access to public funds?
3). Please can the Home Office say to me No Recourse To Public Funds?
4). Please will the Home Office continue on the 3 years or change it to 2.5 years if I fill a wrong form?
5). Based on my child's MEDICAL issues which is still on-going is FLR(FP) the right form to complete or FLR(O)?
6). Please is the FLR(O) being phased out and replaced with FLR(FP)?
7). Does anyone knows how long its going to take Home Office to extend my Leave
Please can people please advise me.Thanks.

FLR(O) application, claiming public funds is fine. Extension should be granted if circumstances similar, can apply for ILR after 6 years DLR. an extension decision is usually quicker around 4-8 weeks after biometric enrolment.

If your child has health problems, consider putting in an application for disability living allowance.

Thanks Amber unfortunately the child with the medical issues does not live with me, she lives with a family member who claims her disability, child tax and child benefit. But I do have her with me every weekend and all mid term breaks. Please can someone still help answer the questions chronologically as listed.
