Discretionary leave for 3 years

Post by ikaika » Thu Jan 26, 2012 7:58 pm

Hi there all

I was wondering if anyone could help
I was given 3 years of Discretionary leave where i i think i should have been given Indefinite leave to remain
I'll write my case fully
back in 08/2001 i came to UK illegality with my daughter she was 6 years old
In 11/2008 I've applied for indefinite leave to remain on the grounds of child being leaving in UK for 7 years illegally
In 11/2009 we ve got refusal on the grounds of entering UK illegally
re applied again
In 07/2010 refusal again on the grounds of we are not family
Appeal again and in Nov 2011 i was given 3 years Discretionary leave to remain
Back then when we applied there was a low for children being living in the country for 7 years to be given indefinite leave to remain

DLR seem like the right leave in light of this judgement..

DP5/96 was meant to apply to cases where enforcement action was under consideration. It is not automatic and it takes the family immigration history into consideration as well.
