Discretionary Leave to Remain

Post by Mammany » Sat Jul 12, 2014 6:42 pm

Dear Amber
I am new to this forum and I badly need your advise
I was granted DLR in April 2012 based on private and family life as I got married in October 2011. I claimed asylum since Sept 2009 but got my first refusal from HO in 2011, went to court was refused but was granted another appeal. When I got married, I let the HO know about it, my case worker asked for me to send in my marriage certificate, letters from friends and priest which I did and they proposed I withdraw my appeal then I will be given 3years DLR. I have a daughter (British 2years old) but my relationship has broken down and I must renew next year April. My questions are the followings
1: will I be granted another 3years based on my daughter as I got pregnant the same month as we got married.
2: the relationship broke down not cos of my fault but cos of my husband treatment towards me, will I be held responsible and not be giving an extension due to the fact I am no longer with him?
3: what does the law says about someone who gets verbally abused and being treated unfairly by someone just cos they think you need them?
I know it's a long message but I will appreciate if you can help me
Thanks

Amber

So far as you have contact with your child, your leave should be extended. If you are being abused you should contact the Police and your local women's support agency.
