EU Divorce and retained right of residence

Hi Everybody,
it might seems a silly question, but i want to clarify and to be sure.
My question is: To get retained right of residence, does it make a difference if EU citizen OR non EU citizen applies for divorce???
and the reason of divorce is against EU citizen or non EU family member???
My question seems silly, but i am expecting good answers please :p
