Divorce petition - Petitioner & respondent swap

Hi,
If twice times court has returned the divorce petition form & fee to the petitioner due to filling the form incorrectly but now respondent willing to become petitioner because of having being filled the divorce petition accurately?. In this scenario, can the respondent become petitioner by submitting correctly filled petition with fees with the believe that no case has yet been created??

I am not fully sure but can guess that it is possible because without fee & form being processed almost in any category either immigration or family matter no proceedings will officially starts. In my point of view, return of fee and form is equal to no proceedings have ever been initiated. Others may correct me if I written wrong.
