Hi all
I am a 27 year old polish lady and my fiance is a 31 year old male from zimbabwe. He first came to the UK in 2005 on a 3 year student visa and then overstayed.
At some point in time (exact date unknown) he lost a folder containing his birth certificate, national ID and passport. He was in a relationship with a lady, who then mothered a child by him.
In 2011, my fiance was granted Discretionary Leave To Remain after an appeal for a failed Assylum application by the courts (immigration tribunal ???) on account of his estranged daughter, born in January 2011, in Italy, whose mother is italian and now live in italy.
I met my fiance in december 2012 and have been living together since may 2013.
In 2014, a month before the DLR was due to expire, He applied for an extension which was denied by Home Office in 2015. An option to appeal was set in the paperwork but due to the very confusing nature of the language he simply responded asking for further evidence to be considered because it had not been submitted with the original application. The home office responded saying in short, they would not accept any further correspondence regarding the case and as such none of the paperwork had been looked at.
Now we are unsure what to do. Because he has no passport the local registry will not marry us and as a result he is also unable to travel.
Can anyone please chime in and suggest or recommend a course of action to take.
Things I would like answered include
1)whether or not it is possible at this stage to make a fresh application under the EEA route ?
2)is there a way to invoke marriage on any grounds whatsoever (european convention etc) even if my fiance has no passport ?
