Who has legal custody of the children at the moment? Would that be you and your spouse in the UK, even though clearly they are being looked after by someone else in your country?

Or does someone such as a relative have legal custody?

And the place in which you are living, is it big enough to accommodate both you and your spouse and the two children?

They are presntly under the Guardianship of my parents. We still have the legal custody of them. We are living in a two Bedroom House.

OK, in order to get them dependants' visas you will need to show that they can be supported without recourse to Public Funds, that the accommodation is "suitable" and certainly not overcrowded, and that they are indeed your children ..... their birth certificates will need to be supplied showing the names of their parents .... and also your passports (or certified copies thereof) showing your names, and indeed the UK visas in those passports.

Do appreciate that you and your spouse will not be able to claim Child Benefit nor Tax Credits, well not until you have ILR.

But no problem the children using the NHS and indeed state schools.

How are you going to achieve this? Are the two of you going to fly back to your country (with lots of supporting evidence), get the children passports and then submit the applications while you are still there in your country?

Hi John, Thanks once again. As you may know that we lived with our children Abroad before coming to UK and sending them to India, my wife is going next month to get their visa and bring them here, They have passports, birth certs from Bahrain and hope these are the needed supporting documents such as Tenancy contract, bank statements, salary slips etc. Hope these will be enough for the visa as mentioned in your above post.
Is it possible to submit the documents before my wife reaching there? Through my parents.
