Does anybody know UK imigration? I need advice

Post by tatiana » Mon Aug 24, 2009 4:27 pm

I need advice, I have been UK for 3 years. I came here in 2006 for my husband. This is my second marriage. My husband is a British guy. we met in Russia 6 years ago.Last year I took ILR under basis of marriage. My husband changed. He was very rude and domestic violence. I left him after ILR. My husband and I live separated. I have a son but he is russian because he has got different father. Am I entitled to apply on the basis of marriage to a British citizen?

If you are enquiring about naturalisation as a British citizen on the grounds of your marriage (i.e. qualifying period 3 years in the UK of which 1 is free of time restriction), the UKBA advice leaflet says this:

"be the husband, wife or (from 5 December 2005) the civil partner of a British citizen on the date the application is received"

So if you haven't actually divorced your husband, you may be qualified. There are some on this forum who seem well versed in the citizenship requirements, so perhaps they can confirm this.

If your enquiry was not about acquiring citizenship for yourself, perhaps you could clarify what you mean.

Since you already have ILR, you can apply for Citizenship regardless.

This is from the guidance notes published with the application form:

"1.15 Indicate your marital/civil partnership status by ticking the appropriate box. You are for our purposes married even if you are now legally separated. You are single if you have never married, are widowed, divorced or your civil partnership has been dissolved."

Have you passed the Knowledge of Life in the UK Test?

I believe that if you're applying as a spouse of British Citizen you will have to submit your husband's passport.
