Does it come in criminal record and will it affect on my vis

Post by Riya12 » Sat Mar 15, 2014 4:24 pm

Hi All

First of all I feel very ashamed and sorry. I will never do it again, I learnt a big lesson today.

I'm a student in UK, today I went to boots and stole 1 makeup item, I seriously do not know what happened to me on that why I did that. he caught me and took to the room, after few minutes they called the police. Police took all my details and said they will not fined me because I did it first time and warned me if I do it again they will arrest me, they didn't fined me ( £80) .

But Boots store banned me and they fined me £87 pounds.

could anybody please let me know :
1. Does it come under criminal record?
2. will it affect my visa extension because I am going to extend my visa next month. I finish my course and thinking to go Tier 2 general or may be apply for tier 4 further study, what will it affect on my visa?
3. shall I have to write 'Yes' in my visa application column where they ask about 'criminal record'.

Thames Valley Police gave me one piece of paper it called ''proportionate Investigation Declaration'' where they put my Name, date of Birth, Address, so it mean It doesn't come into criminal Record?
if in future i need police clearance certificate will they mention this incident on there?

Please help me, I am really worried and feel sorry for that mistake which I did.
Many Thanks

How long your VISA is valid ? After sometime request for SAR and see if it appears in police record. If not then you will be ok.

I'm helping you because you have admitted your mistake and you are regretful. Stick to your resolve and never ever do it again in any country regardless of it's impact on VISA or otherwise.

First step towards correction is acceptance of problem which you have already done .

Your VISA is expiring soon , so probably you don't have time for SAR. As far as i know as police let you off considering you have done it first time , probably it won't appear as criminal record.
Any comment from guru/moderator will be a great help for you.

Should have no bearing and doesn't need declaring. Silly mistake but you seemed to have learned your lesson.

Thanks Amber, for your reply. I did big mistake and never do it again, and sorry for that.

Could you please tell about the ''''proportionate Investigation Declaration'' what is that? warning or caution?
because the police officer asked me my id, I gave him my driving licence and he took all my details ( Name, dob, Address) and I signed that form and he gave me 1 photocopy and keep the original one.

Many thanks

No you should not need to declare it. It may be displayed on an Enhanced DBS certificate (jobs with vulnerable people) at the Chief Police Officer's discretion, but I very much doubt it.
