Domestic violence case

Post by Peachygirl » Fri Jul 24, 2015 2:05 am

Hi,

I am new, I would really appreciate it if you could give some needed advice.I am in a abusive relationship with a British man, how do I go about applying for indefinite leave to remain? I really need to leave him but I have no recourse to public funds.

I am on 10 partner route, only been 3 months since I received my biometric card. If I apply for indefinite leave would he find out? I am really afraid of him. I can't let him know I am planning to leave him.

Any advice is very much appreciated, thank you in advance.

Your first concerns should be your personal safety & wellbeing & to get to a place of safety.
You need support of any family, friends you can trust in this situation.

If you don't have anyone suggest call one of these helplines asap:

http://www.southallblacksisters.org.uk

For legal support on immigration matters in such a sensitive situation you will need specialist advice, try here:
http://www.airecentre.org/pages/domestic-violence.html

To move you are going to need a get-out plan and a refuge, You will need to gather your papers and belongings for a potential move at short notice.

To apply for ILR on grounds of domestic violence you are going to need 'satisfactory evidence'.
The background and timelines involved in claiming this ILR are summarised here:

Stay safe and best of luck.

Thank you so much for your advice. I am currently doing cbt for severe depression from years of emotional torture. I also contact a refuge but they couldn't help me because of no recourse to public funds, they will be meeting up with me this week to discuss my options. I am so afraid, even using this site scares me, what if he finds my post seeking help. May God protect me, calling the police is not an option. He already told me if I leave he will kill me, I told him I am afraid of him but he said I shouldn't be, as long as I don't cross him.

My biggest problem is there are no physical scares only emotional ones, which no one can see. I cry everyday he separated me from everyone and everything I know. Now I alone and emotionally battered. I can't even be a proper mom to my 6 children because I am always crying. I have no money no recourse to public funds. He's the bread winner, and remind me everyday, I am not allowed money apparently I am not smart enough.

Will immigration write to him if I leave? I just want to disappear where he can't find me.

Sorry for the long sad story, I really appreciate your help.

Thank you.

It is so sad to hear you are in such a bad way and your self esteem has taken such a battering.
It sounds like you need to take drastic action to move yourself into a safe place.
