My Domestic Worker's Future in UK

Post by ibrahimL » Tue Apr 22, 2008 1:54 pm

Hello Good People.

I have a Domestic Worker (now20) who accompanied me into UK last year from Abroad to take care of the house, take my calls and attend to house hold chores. I am not very clear about what the BIA/Home office Rules says at the moment on Domestic Workers ILR & Nationalisation. She wish to stay as Long as I am in UK and I will be due to get my ILR in the next 13mths. I am currently divorsed (which is why I sought for Domestic Worker) and my Daughter(9yrs) is in custody of my British Wife who now live in Canda while my SON(19) still live with me.

My questions are:

1. Is there possibility of my personal situation (divorsed, traveling)affecting my DW ILR Visa application after she stay for 5yrs in UK? I forsee my SON settling down soon in next few years and my DW will be the only one at home taking care of the house while I'm away (My work require traveling to Australia & US on branch Audit Visits). As long as I pay her bill & she work for me, this shdn't concern Home office at all?

2. I want to invest in my her learning English Language(Bcos of Life In UK Test she'll have to take later in life), can I do this by getting to register her for Study at Home (cos she c'ant attend college at same time, How can I do this pls. This will help her toward getting ILR/Nationalisation. Can someone give me website of institution than can run study at home. She speak englisg but rather "crude local english", but cant write properly.

3. If she wants to get ILR after staying 5yrs, will her ILR Visa still lock her to me as her Employer or will she be free to move out and settle her own life indipendetly? If I plan to release her then, will she need Utility, Gas, Council Tax Bills to apply for Nationalisation etc. How will she do this then since during the 4/5yrs she lives under my roof & I have my name on all my bills. Do I need to get a room for her outside my roof to pay her own bills or what. I fear she might be influenced by Assylum seekers all around my area If I do that & they might missdirect her etc?

4. If shes is able to get ILR then , will her Nationalisation be condition on her working with me still or not. Naturally I see her settling down out of my employment by then living on her own. Will this be a problem getting her Nationalisation then.

Kindly help me here pls.

She came on my VISA(Work Permit).

I was having difficulties caring for my daughter because my wife trip to Canada at randon in the month about her business. And this errupted issue between us, I decided to look for carrer in UK which was unsuccessful because of the condition attached- the carer must be in my appartment as early as 6am to leave at noon when I'm out of the UK etc. I eventually got one from abroad and went for her last year on my VISA.
