DUI with F1 visa

DUI with F1 visa

Yesterday i got a DUI in Idaho, My question is should i hire attorney or lawyer to help me out, becuase my alcohal concentration is not that high, they took two readings, one was 0.085 and other was 0.079 and the legal limit is 0.08, What u gyus think should i go for lawyer or not?
And another question is I am on F1 visa and how this DUI effect my visa status, Will i face problem in getting H1 visa,..
Please help me, i m very much depressed, please help me

Get legal help. DUI is very serious in the U.S. It is difficult to imagine all the possible impacts of having that on your record, but having it removed or reduced can only help you.

I don't think DUI is the kind of offence that would get you thrown out of the US, but it's better for you to consult an immigration lawyer at once.

From what it can be found on Google, it seems that DUI is not considered a crime of moral turpitude and therefore it shouldn't make you inadmissible. But I'd still go and see that lawyer.

It is unlikely to get tossed out of the U.S. over such a borderline case.

But.

The record will remain, and it can affect a lot of other paperwork in the future.

Also, if there is ever a second offense (DUI or otherwise), that DUI on record will haunt you. Authorities (immigration & otherwise) tend not to be very favorable toward a person if they spot a DUI on their record.

The best strategy is to try and get it off your record somehow.

Thus, a good lawyer or other top legal advice. This is not entirely about immigration anymore. Background checks for jobs are affected, insurance rates are affected, etc. etc.

I personally know a girl (on J1 visa) who got DUI when I was in a car with her. She had no problems staying in the US afterwards, but after reapplying for J1 visa she lied about not having been arrested and apparently it showed up on their computer...they did some sorta investigation and her visa process dragged for a month (rather than 1 day) but she finally got the visa.

Ask your attorney upon conviction if an appeal is possible. Ultimately, overturning your conviction is a good way to clear your record, but don't count on it.
