EAA Family Permit expired - RC Pending

Post by jcastegnaro » Sat May 23, 2015 10:48 am

Hi,

I applied for my residence card back in January 2015 because my wife and I are settling in the UK. (We both have good jobs)

We have a family trip soon in Germany so what will happen if I leave and enter the UK with my EAA Family permit expired but my residence card document informing my RC permit in under processing in hand. I also have a valid and certified marriage certificate.

Will that work? Also I do not need a visa to enter the UK but if I enter as a tourist my working status will be "Not allowed to work".

I tried to apply for another family permit in Germany but they have no appointments available on the dates we travel.

I would really appreciate if someone can help or guide me since I tried calling the home office but no one was able to help me.

Thanks,

Javier

Wrong section of the forum to post your query.

You will be admitted if you manage to get to the border, how you manage to do that I don't know. But you should have no problem entering the UK.

I think it's right section to post
As long as I know observing the forum etc though no personal experience
That if you not a visa national and you travel with your EEA partner along with COA and supporting documents then there won't and should not be problem at all at airport.
Only problem people face who required visa that they do not get allowed by air line to board the plane.
When you arrive in the UK then you do not need to declear yourself as a visitor just go along with your partner to immigration desk and claim entry under EEA route and you should be allowed entry and a special stamp called 1A or A1 would be given on your passport valid for 6 months same like FP.
And you would be allowed to work and can enjoy all rights as a family member of an EEA national..
Good Luck....

Good explanation about the stamp 1A! And, yes, it IS the right place for this question.

OP: What citizenship does your wife hold? If it's non-British you won't have any issues! If he/she is British then it could lead to more questions (as they will assume you have been through Surinder Singh).

Gozo: he said he ordinarily doesn't need a visa for the UK anyway, so getting on the plane won't be an issue.
