EEA (FM) Application

Hi Guys,

I am going to apply for Residence Card (EEA (FM) Application) on the basis of having Retain Rights of Residence after divorce with my ex previously had been married for more than 3 years.

So there are some requirements. One of them is that I have to show my ex's payslips as a prove that he was working during the divorce process from 5 June'15 to 7 Jan'16. I can only provide 5 payslips (May'15-Sep'15) and can not do for the rest (Oct'15-Dec'15) as my ex and I are no longer communicating between each other and there are no chances for me to get them (Oct'15-Dec'15 Payslips).

The question: what is the chance that my application will be refused if I can't show all payslips covering whole period of divorce process?

P.S. I have read the guidance which is saying need to provide his 'at least 3 latest payslips before the date of our marriage dissolution (divorce)', i. e Oct'15, Nov'15, Dec'15 payslips. I have his 5 payslips but they are not MOST RESENT ones.

There are ways & means to retrieve such information.

HO/UKVI can also be pressed, under Section 40 of the UK Borders Act, 2007, to check for relevant & necessary evidence related to your ex-spouse.
If UK Border Agency is directed by an Immigration Judge to contact another government department to obtain evidence on the exercise of Treaty rights, the Agency will comply with this in all cases.

In such circumstances, however, UKBA would hope and expect that the Tribunal would not make directions where the applicant has not even attempted to obtain this information themselves.
