eea divorced

I got married to an eea 2006,got a 5 year visa 2007,divorced 2011 retained my right 2012 February,i want to ask please when can i apply for pr or bc cos they give me a 5 year visa again us a family member of an eea,i send them a complain letter which they rote me back and confirm it that i have retain my right us divorced to an eea but still on my visa it says family member of an eea and every time time they i come back from holiday they ask me did you travel with the wife? and when i tell them that i am divorced i have to give them my cover letter which home office have issued me.please if any one knows anything more when or how can i apply for pr or bc?i have asked a solicitor he says i can apply for a British passport but i have proof that i lived with my ex wife only the first two years please does anyone have a similar case or what can i do?

The UK only have one type of Residence Card so even after you retain your rights, the RC still says Family member. In fact, the letter you have is the only evidence you have that you have retained your rights.

Why did you apply for another RC using form EEA2? You could have applied in 2011 for a PR using form EEA4.

If your ex (until the divorce) and you (after the divorce) have exercised treaty rights for 5 years, you have obtained PR. If you meet the requirements for naturalisation, you can apply now for PR and/or BC.

i applied in 2011 for pr using the eea4 form but ho issued me a five year visa us a eea family member,my solicitor send ho a complain letter and they send me a confirmation letter that i have retained my right us divorced to an eea. now i want to apply for pr or naturalization cos they really bother you with all those questions soon us they see the vignette on my passport and the time waiting at the border.only proov i have is that i lived with my wife for the first 2 years 2006 2008 and pay sleeps of 2011 when we got divorced .
for me i have worked and lived in uk since 2006
i just wanted to know is it better to apply for pr or bc?

Well, PR and BC are two different things although the former is required to apply for the latter.

If you are asking if you should apply for PR first or straight for BC, I would recommend applying for PR Confirmation first as the application is free and will flush out any issues with your documents without risking the hefty £850 fee for naturalisation.
