EEA Family permit Expired , UK Entry question

Post by fitzpatrick » Tue Oct 14, 2014 5:13 pm

Hello

I am new here, so If I ask silly questions , please bear with me.

I am an Irish National living in the UK for almost 10 years.

My wife is a US National, living here with me for the last 7 years.

she first had an EEA 6 month Permit, then a 5 year residence card, and then after that expired she got another EEA 6 month permit.

Now that is expired again. She wants to get indefinite leave to remain , but my work requires me to travel every month outside of the UK, so I cannot give my passport away for more than 2 weeks, or worst case 1 month , so we are trying to figure out what to do.

meanwhile, this week, we are both flying for a few days holiday to turkey.

Now when we are coming back, will she have problems returning to the UK since she will be in possession of a Passport showing her 5 year residency has expired and the subsequent 6 month permit has also expired?

she will be travelling together with me

Any help appreciated

Kind regards

Fitzpatrick

Have you worked uninterrupted for a period of 5 years out of the 10 years you have lived in the UK? You may already have acquired PR, on your return to the UK, be sure to have evidence of your economic activity in the UK to hand, she shouldn't have any problem.

Carry your marriage certificate with you and you will fine. They can't refuse her entry (unless they claim she is a terrorist or danger to the public).

Is she interested in becoming a British citizen? Then you can skip the PR application and apply for BC directly using a service which will copy your documents so no need to send your passport to the HO. Otherwise, she can continue living in the UK without a residence document. Should not be a problem unless she travels a lot (and then need to carry some evidence about you with her) or look for employment.
