Hello people,
I have been in UK for 8 months with a family permit of a EU national.
My permit expired on Feb 2019 and I applied for an extension before the expiry date.
My employer suspended me without pay when the visa expired stating that they were not sure about my right to work, consequently I was suspended till recently as now I have been totally dismissed.
It is important to clarify that the extension of my Visa was done by post and consequently I did not immediately receive case ID or reference number.
I HAD TO WAIT.
The first ID Case I received was only on my biometric letter which came after 2 months and with incorrect details.
I had to request another biometric letter.
I gave my employer a letter from my lawyer which included all Acts regarding my right to work even after the expiry date of Visa, in fact,
if applied before the expery date my Rights are supposed to remain the same until the final decision of the Home Office.
I gave to my employer the letter from my lawyer and the biometric letter having the ID case.
They subsequently used the Employer Checking Service of the Uk Visas Immigration
And the outcome was :
"We are unable to provide you with a statutory excuse"
and
" a Certificate of Application has not been issued to this person ".
Basically, I am told that I have the right to work , I was given a biometric letter with wrong DOB and now I have been dismissed from my employer.
Any idea what I am supposed to do?
"We are unable to provide you with a statutory excuse" those is mean that I don't have the right to work? Especially when i was unable to submit my biometrics because of wrong details and consequently the delay of certificate of application?
