My EEA partner is leaving to study abroad.

Hello,

My EEA Residence Card is expiring in Feb 2015. My husband the EEA National has permanent residence as of Jan 2014 due to 5 years continuous employment. We have been together since Jan 2006 in the UK and registered our marriage in Feb 2010 in the UK. We have 3 children aged 7, 5, and 1 year. We have been living separately since July 2011 before we have always been living together. I am nigerian and he is portuguese.

We are not divorced but no longer together. He is leaving the UK to study abroad as of February 2014.

My Questions:
1. Once he leaves the UK do I still have leave to remain or do I have to leave too? Hes being sponsored to study in KSA. I am not working but a lone parent. (He has another partner and child) He will support my application in any way.

2. As he has PR , can I still apply for my PR in 2015 with no problems as I will only need to prove his exercising treaty right till 2014 as he already has PR....also as he out studying I can continue to stay with no problems for upto 12 months right?

3. If I should apply for PR with him in Jan 2014 based on our relationship history and our children will I qualify too or will I be wasting £55?
