EEA Permit - What next?

Post by sombaden » Thu Jan 30, 2020 2:45 pm

Hi

My wife recently joined me via the EEA route as a non-EU national and I am a EU national that has resided and worked in the UK for the past 15 years. As I understood the next step is to apply for a residence card however with Brexit my own status will need to also be addressed. Before we left the EU years prior I had applied for a permanent residence which I acquired in 2016. Now with all this talk of a pre-settled status applications I got confused as to the validity of my permanent residence.

Question is do I apply together with my wife for the EU Settlement Scheme (settled and pre-settled status) or do I have to do a separate application for her residence status?

You apply for settled status, your spouse pre-settled.

Even if you have permanent residence, you have to apply to the Settlement Scheme. Your application will be straightforward and likely dealt with within 48 hours, and you should get Settled Status.

Each person has to apply separately. The way to do it is you apply first, then your wife. This is so that she can include your application number into her application (there will be a special field for that) and get them "attached". If you do it the other way around (your wife first then you) her application will be delayed, since it will not be linked to the application of any EU national.
