Anxious regarding EU settlement application with Northern Ireland spouse issue

Anxious regarding EU settlement application with Northern Ireland spouse issue

Hi,
I have applied for pre-settled status using the online EU settlement application process as the non-EU spouse of an EU national. My wife's status is complicated (she was born in Northern Ireland and holds an Irish passport and identifies as Irish). We have returned from Australia to live in NI and I submitted my application in early Dec. 2019. I completed my biometrics and received my COA in mid December 2019. That's it, nothing since.
I've phoned the Home Office at least 8 times since February but feel like I'm getting nowhere.
That is, until I said I wanted to make a formal complaint, around the middle of May. I received what read like a standard pro-forma response to the complaint, stating that they are still completing checks on my application, sorry for delay etc etc.
However, a few days later, just last week, they emailed me asking for additional information regarding my wife's parents' status at the time of her birth;
  • Mother & Father's DOB;
    Places of birth;
    Nationalities;
    Marital Status;
I was able to ring up and provide these details to the call centre operator who noted this info to pass on to the case worker. During the call I was also advised that if it comes back that either of my wife's parents are dual citizens (British and Irish) then my application is null and void!! He also said that I then have the option of applying by the paper route, which would re-start the application process. I don't understand what the difference would be!
We are now concerned that the Home Office will use my wife's parents' status as a reason to reject my application. Both of them were born in N Ireland.
We have heard about the Emma de Souza case which is similar to ours (her spouse is American and she successfully fought an initial decision to deny her the right to apply for settlement for him, as an EU citizen herself) She fought and was successful in her argument that she had the right to identify as Irish under the Good Friday Agreement and didn't need to renounce British citizenship before re-applying as Irish.
We are wary still, because even though Mrs de Souza has got what she wanted, I read a BBC article stating that this law is effective from August 2020 until June 2021. Perhaps my application will not have this new change applied?
Does anyone have any insight in to mine or similar cases or have any experience of same?

I had similar circumstances but choosed to renounce wife British citizenship.
Home office is unpredictable at times but practically thinking your current application is void because of your wife British citizenship specially considering that home office is already actively looking into establishing your wife's dual citizenship.
I really hope that you are not penalised for answering the question regarding her British citizenship incorrectly as it is one of the 2 questions asked when applying online.
( talking about northern Irish people it can be debated)
The good news is that even if your application is considered null then you will have the opportunity to reapply in august as home office is aiming to accept the applications from northern Irish born dual citizens but I am not sure if that change will be applied retrospectively or only from the august.

This is the De Souza case scenario.

Your wife was born in northern Ireland to parents who were born in northern ireland. As far as UK nationality law is concerned she is British. At the same time based on Irish nationality law she is Irish. Up to 24th August as far as home office is concerned she is British and you cannot use the eu settlement route unless she has exercised free movement rights in eu before return to UK. Does not matter that she does not consider her self British and only identifies as Irish. Best case scenario is that they park your case until 24th August. If decided before 24th August then expect will not be approved.

Good news. On 24th August your wife becomes a relevant person of northern Ireland. At which point she can sponsor you on eu settlement scheme and life is good. You might have to apply after 24th August to the eu settlement scheme.

I'm waiting for 24th August to get wife's application in for eu settlement scheme and get her moved from spouse visa route.

Annoying that takes so long to come into effect - one reason for not rocking boat when they are not doing anything as likely to be refusal if decided before as definition only changes after that.

Would appeal if negative decision and stall until 24th August in that scenario.

Thanks both of you for replying.

I can't believe I'm writing this but I got notified late yesterday that I have been granted pre-settled status, with right to live, work and study in the UK, valid for 5 years.

To say I'm delighted is an understatement - plus relieved, as after reading your replies I was really fearing the worst.

Oh well, I'm glad we can now look forward to building a life here and I wish you all luck with your applications.

Thanks for the update and congratulations.

Don't normally like being proven wrong but in this case I'm delighted as did think they would apply the rules as now as opposed to what they are changing to. Home office applying common sense.
