Timeline-
Non EEA -PR as Extended Family Member (Unmarried Partner)

Application Sent 06-01
Application Received 07-01
Payment taken 08-01

waiting for Biometrics.......

I received my Biometrics letter today as well as COA stating "thank you for your apllication for Residence card" in the same envelope also further stating I do not have right to work. Kind of confused. Don't you send Biometrics before receiving COA?

hi mi55ytee

Perhaps the Home Office will not be able to establish whether or not you have the right to work until your application is processed.

Post by Taci » Wed Jan 27, 2016 11:44 pm

have read this post gave me hope about the process time application.
I am EEA national living and working continuous in this country since 2001
I got married with a Brazilian in November 2010 and he got his visa (Residence Card of Family member of an EEA National) issued on march 2011 valid until 11/03/2016. I have the registration certificate done at the same time as his visa 08/03/2011.
I want now to apply for a PR for both of us.
I have filled up the form being the main applicant and my husband as a family member.
my question is on section 3 - about your application
3.1 - I ticket the second box I lived in the uk for a continuous period of five years.....
do I need to complete section 3.2 for my husband and this still about mine? if so do I need to tick box 1 and then complete the section 11 at some point? or just section 5,9,16,17,18 and 19
also we have a son (with British passport) as I was living and working in this country for more than 5 years when he born. do I need to send any document from him? it this will help my husband with his PR?
thank you

Hi Beaujam90,
Thanks for your quick response. The question should be is it normal to receive the biometrics and Coa on the same day?
COA are normally issued after biometrics has been enrolled. I found this really unusual.
Has anyone else experienced this before?

Hi,

I hope someone can help.
I'm and EEA national (Polish) and need to fill in Section B in Q9 as an accession worker. I entered UK in Oct 2007 but haven't done my WRS till Dec 2009. I have to list all the 'illegal' employement in 9.18 - could/will this affect the PR decision? (I'm all ok from Dec 2009 and had my WRS valid for 12 months with same employer).

would having section 9.18 filled in could result in dismissal of my PR application? I don't feel I can just skip the question as this apply to me.

Hi everyone,
I have started to worry
The HO received my PR application on 13th August 2015 and I submitted my Biometrics as requested and received my COA.
Now I started to worry as it has been 5 months and 15 days and my application has not been processed.
Is there somebody who has similar experience who submitted in august and their app has nor processed yet/
Please post your timeline.

I'm in the same situation, had 5 years of "illegal" work prior to completing my 12 months on WRS. I listed all "illicit" work in section 9 and sent the application 2 days ago. Let's see what happens. I am not prepared to lie or hide anything so if they reject my application so be it.

Working without having been on WRS will not prevent you from getting a PR card. As long as you have been exercising treaty rights for 5 years (working on WRS, or after it was abolished) you will be fine. You acquire PR automatically after exercising treaty rights for 5 continuous years and UKVI cannot deny you a PR card/certificate just because you had some period of "illegal" work before that.

You are a life saver! One more question- absence from UK. Form states 'if there have been absences since entering UK' .I've been here since 2007 but can I only provide absences for past 5-6 years only (from Dec 2009)? I had small absence before 2009 for visiting family back in Poland but usually for a week and maybe 3 times in that period but I cannot find exact dates at all for them.

Only need to list absences from the start of your qualifying period until present day. The form asks for a tremendous amount of information, most of which you are not legally required to give in order to obtain PR card/document.

Received by HO: 7th August 2015
Fee taken: Yes

Thanks again! Unfortunately after spending 2.5h filling the form and looking for all relevant info I just came across this:

My 1st WRS was issued on 18.12.2009 with Employer A, I have started working for Employer B(still my employer now) on 10.05.2010 but updated WRS says issue date is 17.06.2010 so 37 days after I started my job. I have no idea when Employer B applied to update WRS. In this case:
1. Can I assume they applied within 30 days (or check with HR when they applied) and hope that HO will grant the apply date and not issue date or;
2.Use 17.06.2010 as start of my qualifying period or;
3. Assume nothing is valid and wait till April this year exercising my right because WRS was abolished in April 2011.

Thanks again
1 problem solved and 2 in it's place :(

Hi Hasskyratt/Selfie 000,

Here is my time line
Applied for PR - 11th August, 2015
Application Received - 14th August, 2015
Money Taken - 20th August, 2015
Bio-metric - 24th August,2015
Bio-Metric Sent - 02nd September,2015.
COA Received - 18th September
PR - Still waiting.

I called HO last week Friday and was told my application is still open and a decision has not been made yet.
I was told to call back third week in February if i still haven't received a decision from them.
Then my application would have exceeded 6months.

I hope I get my PR soon... This waiting game is killing :( !

Funny that, but again the same situation here. I have no idea when my employer applied but I know the issue date. I left the application date blank in the form and counted the period from the issue date. At the end of the day as long as you have 12m from the issue date + 5 years from the issue date the application date shouldn't matter.

I'm just worried that WRS has been broken because renewal wasn't within 30 days. Surely they should use the application date rather then issue date of extended WRS with Employer B. Not my fault if HO haven't processed this in time but then arguing with them could be costly.

If the renewal wasn't during 30 days than you can only count from the issue date. I got caught by that in 2004.
I applied 9 days after the 30 period ended and that made my next 5 years of work history "illegal" because I changed my employer 12 months after I started but only 10 months after the issue date. Had I applied within those first 30 days ......

Yep that's the problem- no idea when application was made (if within 30 days) and my HR is no help either. Might just bite the bullet and go with 17.06.2010 as my start date of being 'legal' and all that. Then I could apply for BC in June this year.

Not really. You can apply for BC one year after being granted PR. So apply for PR asap and once granted you'll have to wait one year before applying for BC.
The law changed in November 2015, automatic PR doesn't count anymore, you need a physical PR paper.
