Can change family visit to eu settlement status

Hi ,

My mother in law applied eu family permit and today got refused on the base of-
You have provided money transfers for July to August 2021. It is noted that you have
not provided any evidence of your own domestic circumstance in India. Without such
evidence I am unable to sufficiently determine that you cannot meet essential living
needs without financial or other material support from your relevant EEA Citizen
sponsor or their spouse or civil partner.

Please help me I have been a advised by someone my mother in law can change uk family visit visa to eu settlement status in the uk.

I am Spanish national and got eu settle status in the uk. Also I am married in 2005. My mother in law( wife mother) have already 10 years family visit visa . Can she apply eu family settlement status in the uk when she come in the UK.

In her case, this is pointless.

In general terms, it is possible to come to the UK on a visitor visa and apply for the EUSS, but in her particular case this won't work, because an application for a EUSS Family Permit (the one she just got refused) has pretty much the same eligibility requirements than the pre-settled status. The only difference between the two is where it is made (FP is done abroad, pre-settled is done in the UK).

Bottomline is, in the EU settlement Scheme, dependency of parents is no longer assumed, so for pre-settled status she would have to provide the same kind of dependency evidence she wasn't able to provide for the Family Permit. If she doesn't, she'll get refused again.
