I made an application on the 01-02-2021 to update and replace my biometric residence card which was issued under EU regulations to EU Settlement scheme. I was granted Settled status (ILR) and received a letter dated 30-01-2021 to confirm this. I attended an appointment with Sopra Steria (UKVCAS) on the 15-02-2021 to provide my biometrics information and any documents which were requested as part of the application. However, I have not yet received a decision on my case I have been having problems in viewing my status online. I have tried to contact EU Settlement Resolution Centre about a month ago and was advised I will be contacted with a update once the issue has been corrected. Unfortunately I haven’t heard anything until now and I am still unable to view the status. It is becoming a serious problem for me now as I am at the stage I need to present the evidence of my status to my employer to be able to continue my employment. My employer does not accept the letter so I need to be able to show them this evidence online.
I would like to share good news I got my BRC received today . I have received email from APAD on 25th of March so all the best for who waiting

It looks like copy/paste card to me, it was slow even by HO standards.

Please, can someone help me with this;

I have read the whole topic and I am again (as usual) totally confused about if we need to replace our EEA BRCs with EUSS ones :( We entered the country in early 2017 so our fifth year will be completed in 2022. Me and my children got pre-settled status in 2019, additionally I had used EEA residence cards ( expiry date 2024) during the applications. Here is my problem;

We have an appointment in another country for our children (citizenship) in July 2021. We struggle to postpone it as they refuse to change the date. Anyway, if we can travel in July will we need new BRCs issued under EUSS when entering back to the UK or they only check our status online and accept old BRCs?

No.

Do not ever assume en electronic status can be checked at airports and allow you to travel. See this post.

Hello everyone,
What if I don't apply to change my brc and keep the one under eu law with a settled status? Will it be invalid after 21.06.2021 ? Means I cannot travel or re enter uk with it ?
Overall ,what's the point of doing this if I was granted a settlment status ? Why home office ask you if you want to go ahead with your application after you submit it ? Don't think it's a mandatory thing ?

You don’t need the new card if you already have a status... it’s only a wish if you want to change the card.. other than that you should be fine,Dong worry about the new card

That's only the case if you are not planning on traveling abroad ever, which is true for some people.

But @imbik needs to travel. They need a new card.

It has been widely documented, e.g. in the post and article I shared in my previous answer, that electronic status is NOT a guarantee to be allowed to travel back into the UK.

Yes. It will be invalid after that day, so this strategy only works until then.

Some people don't need a physical card, for example, if they never travel abroad. Wild guess is it's cost-effective to only process cards to those who ask for it. Not saying I agree, just that's what seems to be the rationale of the Home Office.

As above. There is a difference between legally mandatory and purely practical. You won't be illegal without it... But you won't be able to travel.

I asked the EU settlement help line about EU residence cards being valid post June 2021 and they said it was as long as status under the EU settlement scheme is granted. This make sense as they don't seem to be issuing EU settlement scheme residence cards to those who already have one issued under the EU freemovement directive. Therefore it's not necessary to change your residence card but to prevent any potential issues on re-entering the UK, it may be better to apply to replace it.

This brings back bad memories from my own research last year. In general I find the advise of the EU Resolution centre quite narrow, incomplete, and contradictory, and I always take it with a pinch of salt.

That being said, by all means you did what was appropriate by reaching out and ask. This might have improved and what they say this time might be actually accurate? :shock:

Keep in mind you can always apply to convert the card afterwards. This only means the change of card is not legally necessary to live and work in the UK, but does not mean you will never need the new card (for traveling for example).
Therefore it's not necessary to change your residence card
As per rationale above, the fact that you do not get automatically a card is not a logical conclusion, or a guarantee, that you will never need the card.
but to prevent any potential issues on re-entering the UK, it may be better to apply to replace it.

I agree with kamoe on this one. I've heard many, many, many stories when HO staff didn't know what they talking about and was actually correcting officer at the border on my rights when she tried to make things difficult for me. Better to pay those scamers from SS for biometrics, than on your way back home(with full bags and crying kids) to be denied of entry.

Your application will go ahead only after you submit biometrics.

How is that possible to have a BRP under the EU Settlement Scheme which expires in 2022? I thought they're all issued for 5 years exactly, and HO started issuing them in 2019 only. So the earliest expiry date should be in 2024?

This page (https://www.gov.uk/uk-residence-card) clearly says : You can no longer apply for a UK residence card. If you already have a card, it will not be valid after 30 June 2021.
