Dear members,My wife has a old brc under Eu family member, she applied for presettle status on 2019. Before married me on 2017 she had a working visa brc on 2016 . She applied for settle status 1 week ago they gave her again a presettle status,the reason is because they said: she needs to have 5 years of marriage with me ,soo from 2017 ..I was surprised honestly.They said to reapply on 2022 but the scheme will end on 30/06/2021 .. I don’t know next year how to apply for settle status if the scheme is not open.I have 2 questions:
1 : her old brc card EU family members is valid for travel until the expiry date 2023? Or she has to change on the settlement scheme ?
2 : when she applied from presettle status to settle status they didn’t let her upgrade on settle status and they gave her again presettle status again until 2025 ,we need to wait again 5 years? Or we can reapply next year?? And how if the scheme will end in 30/06/2021

Hi Euge,
1. your wife has to live 5 years under pre-settled status or previously under EEA family member in order to be qualified for settled status (EU Settlement Scheme). Year 2016 was not counted as she lived in the UK with Working Visa not. The GOV site is quite vague on this. If you believe that there has been a mistake on their's end, you could apply for an administrative review via HERE
2. Your wife would be qualified for Settled Status under EU Settlement Scheme in 2022, assuming that she got married to you in 2017 and she has been granted pre-settled status or previously under EEA family member.
3. her old brc card EU family members is valid for travel until the expiry date 2023? [to be on the safe side, I would suggest to replace her biometric card to the BRC under EU settlement scheme. Rumor said you don't need to as employer or any other relevant parties can check the status online and her BRC under EU still valid thru 2023. However, I went on the safe side to have a physical evidence as it will be handy that everything is reflected to the actual status, i.e for travelling abroad. It's free and straight forward process.]
4. when she applied from presettle status to settle status they didn’t let her upgrade on settle status and they gave her again presettle status again until 2025 ,we need to wait again 5 years? Or we can reapply next year?? And how if the scheme will end in 30/06/2021 [The Scheme is ended by 30.06.2021 however, it does not mean that transfer status to settle status is closed, this is clearly explain in HERE. The latest you could apply for settled status is on 14 January 2025, just before your pre-settled status expires.]

Is there anyone still waiting while they sent the online application in 2020?

It starts to get really frustrating to see people with an expiry date after mine (06.2020) getting their card way before me, while I made the application a few months before. It will be 5 months of wait soon... It's tough to understand the reason.

I sent an email to APAD, but they said to be patient, prioritising applications based on the expiry date... But reading the forum here, if it were the case, I'd have my card a few months ago.

My wife applied in December and did her biometrics in January. We just got the card delivered today (we did send an email to APAD about a week ago but not sure if that helped or not) so that was about 4 months for us.

On a slightly different note, the email we received from APAD says that we should return the old BRC to them (not sure what's the address though - I presume the one in Bristol?). Do we really have to return the old one or can we just cut it into pieces? Feels like an unnecessary chore since they mentioned the card was already invalidated.

In my case I have to return it to Bristol, see quoted below from the email I have received from APAD:
Thank you for your application for a replacement Biometric Residence Card (BRC) issued under the EU Settlement Scheme. The replacement card will be sent to you under separate cover. You should receive your card within 7 working days. However, if you do not receive the card(s) within 10 working days of the date of this email, please use the service at www.gov.uk/brp. Alternatively, you can send your full name, date of birth, nationality and contact details by post to:

Returns Unit
P.O. Box 163
Bristol BS20 1AB
Please note that on delivery the courier will require proof of identity and a signature to confirm receipt of the package.
You are advised not to make any travel arrangements until you have received your replacement BRC.
You did not provide your previous BRC in support of your application. It has been cancelled and is no longer valid for use. You must return it as soon as possible to the above address, so that it can be securely destroyed. I know it seems unnecessary but I don't want to get any future implication so I will do as suggested.

Thanks! The email you received is a lot clearer than ours. We will send the old BRC to that address as well.

I have the feeling people who sent an application in 2020, whatever the expiry date, are treated with a lot more delay. Is it just me?

Quick question for people with electronic status trying to get the physical card:

Before upcoming biometrics appointment, Sopra Steria is reminding me to upload my supporting documents. But... My status has already been granted, and this is already on the record. I am just assuming they don't really need anything else from me, and that message is just boiler plate for people actually applying for statuses not just the card.

Am I right? Can anyone with electronic status, applying for the physical card, please share a recent experience of not uploading anything else before biometrics and yet obtaining the card with no problems? Or if we need to upload anything, what is it? Current EEA RC? Passport? Seems a bit repetitive.

Yes same answer which is not true because lot got their cards which expires in 2022 and more

After the application you are shown a list of mandatory documents to upload on Sopra Steria website. Mine was BRC, consent to carry out checks and proof of address.

Yeah after the reply from @TerryGH I noticed mine was simply "UK residency". What that meant, I don't know,but just to be on the safe side I uploaded copies of all my BRCs to-date, driving license, recent bank statement, and council tax. Plus consent form. Had appointment and submitted today. Fingers crossed I have not missed anything, I feel it wasn't very clear.

Yeah after the reply from @TerryGH I noticed mine was simply "UK residency". What that meant, I don't know,but just to be on the safe side I uploaded copies of all my BRCs to-date, driving license, recent bank statement, and council tax. Plus consent form. Hi, i have made an application to change my brc issued from eea to euss. I did bio in February.
I did not recive any email fo consent or any further communication from the home office.
Has anyone else experienced this.
