Yes all bills, bank statements etc were for the same address for both of us.

i have read ur case. I am also in the same situation. could you please tell me how you managed to get the confirmation from your ex 's employer ????

And what other piece of evidence you provided for your ex' exercising treaty rights???

did u hire any detective ???? May i know the details of your solicitor plzzzzzzzzz.

1. I sent them all for 3 years of marriage (they normally ask for 1 year proof)
2. Originals. HO do not accept photocopies.

Also a bit of your story, please. I just need to find out wether one of the spouse should inform HO about separation, before actual divorce has taken place.

You need to inform HO after decree absolute received. My story in the beggining of this topic.

I meant a bit of the story when u were separated.
I have been separated for 5 month now and what to know wether its must to inform HO about it or wait untill divorce. Couldnt find any info.

hi obie: i want to ask you that once you apply for retention of right you have to show the treaty rights for eea national from initation of divorce till decree absolute or for whole of 3 years period.
if it's only for that duration i mean from initiation of divorce till the final divorce then could you please guide me from where you have this information.one of my friend who suppose to apply for retention of right within couple of months time so please help me.thanks

Hi Guys,
my story is as folow regarding the topic of EEA Divorce,

married Nov,2006
RC issued, Feb 2008
divorce. April2011
sent my app to HO a week ago.
document attched,

Passport
a covering letter with 2 photos.
Decree absolute
joint bank statement( covering 3 years)
Employers letter for my self.
Employers letter for my Ex. (that she is currently working)
P60s for myself and Ex.
Pay slips of both( covering 3 years )
I hope that would be enough..

Hi Guys, Its me again, send my application for retaining my rights following the divorce with my eea spouse on 13 April. its over 3 weeks now.
does anyone knows how long it takes to get COA? and if some body who has gone through the process could also tell me that if I had the right documents send to the HO? as I mentioned in my previous post.
Mr. bobobo was quite experienced... I will Really apreciate some info sharing...

Kampk121 - it take about 4-6 weeks to get a CoA so I wouldnt worry about anything. If you are still worries just call the HO after a week and request them if they can send another CoA. Though Applications are being processed faster now, the HO will not entertain any calls before 6 months have elapsed.

As per your documents, they seem to be sufficient. You will find out as if they need something they will contact you. Did you send Decree Nisi as proof of when divorce was initiated. The HO would need that to make sure the marriage lasted atleast for three years before divorce proceedings were started.

Hi bobobo, tkx for ur reply. I didnt send the decree nisi. as on the Decree Absolute it states the date of Decree nisi been issued. which was Dec, 2010. and absolute on April,2011.
Im also hasitating to provide Decree nisi as it states on it, that we have been living separately for the continuos period of two years! and I actuelly think they(HO) might object my case? what is ur personel opinion?
we married in Dec 2006. out of that period 1 year was out side UK. and 3.5 years in UK. I will really apreciate ur time taking this....

Hi Guys, As you know my story from the previous posts.I applied for retaining the rights following the divorce.
Received a CoA this week.
its says on the letter, Thank you for youe Application on April 2011, For "Pemanent Resident Card".
when I did not applied for permanent residence.
does any one know about that?
has any one got the same letter recently?

HO uses specific templates to address all queries. I wouldnt be alarmed by this. as long as you have something from HO its good enough. if I remember correctly I got the same CoA from them.

Hi Guys. I have reatained my rights following the divorce with EEA national. I applied in mid April 2011 and got new stamp after about 3 months.
and a letter stating that. I no longer depend on my spouse.. :)
and I can feel free to apply for PR when i am eligible :D

Hi,Please those of you that have retain right of residency with your new RC,has anyone got their PR.The reason I am asking is that a friend of mine is confusing me that I will need to use the new RC retained,which I disagree because by Feburary next year I will be 5 yrs in the UK and I can apply for my PR! Please anyone who retain their RC and have got their PR,please let me know,if you use all the new 5yrs or just the 5yrs in Uk.

Once you complete 5 years you can apply for PR confirmation. You don't need to wait another 5 years on the new RC. The tricky part might be to provide evidence of your ex exercising treaty rights before the divorce. Normally this would require some cooperation (and documents) from your ex.

Thanks for the reply.But do you mean after I retain my RC,I still need to show evidence of ex again when I am applying for my PR.But it will be same documents that I use to retain my RC or I need to show are current treaty rights? Please your answer will greatly appreciated.
